1. Acceptance of Terms

By accessing or using RealIterate, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our services.

2. Eligibility

You must be at least 18 years old to use RealIterate. By using our services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

3. Account Registration

To use certain features of RealIterate, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms or contain false information.

4. User Content

You retain ownership of content you create and share on RealIterate ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and distribute your content for the purpose of operating and improving our services.

You represent and warrant that:

• You own or have the necessary rights to your User Content
• Your User Content does not violate any third-party rights
• Your User Content complies with these Terms and applicable laws

5. Prohibited Conduct

You agree not to:

• Violate any laws or regulations
• Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy
• Impersonate any person or entity or misrepresent your affiliation
• Upload viruses or malicious code
• Spam, solicit, or harass other users
• Use automated systems (bots, scrapers) without permission
• Interfere with or disrupt the service or servers
• Attempt to gain unauthorized access to any part of the service
• Collect or harvest personal information from other users
• Use the service for any commercial purpose without our consent

6. Content Moderation

We reserve the right, but have no obligation, to monitor, review, and remove User Content that violates these Terms or is otherwise objectionable. We may use automated tools and human review to moderate content.

7. Intellectual Property

RealIterate and its original content, features, and functionality are owned by RealIterate, LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not:

• Copy, modify, or create derivative works of our service
• Reverse engineer or attempt to extract source code
• Use our trademarks without permission
• Remove or alter any proprietary notices

8. Privacy and Data Protection

Your use of RealIterate is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using our services, you consent to our data practices as described in our Privacy Policy.

9. Subscriptions and Payments

Some features of RealIterate may require a paid subscription. By subscribing, you agree to:

• Pay all applicable fees as described at the time of purchase
• Provide accurate billing information
• Authorize us to charge your payment method on a recurring basis
• Be responsible for any applicable taxes

Subscriptions automatically renew unless canceled before the renewal date. You can cancel your subscription at any time through your account settings. Refunds are provided in accordance with applicable app store policies.

10. Termination

We may suspend or terminate your account and access to RealIterate at our sole discretion, without notice, for any reason, including:

• Violation of these Terms
• Requests by law enforcement or government agencies
• Extended periods of inactivity
• Technical or security concerns
• Engagement in fraudulent or illegal activities

You may terminate your account at any time through account settings. Upon termination, your right to access and use RealIterate will cease immediately.

11. Disclaimers and Limitations of Liability

RealIterate is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The service will be uninterrupted, secure, or error-free
• Results obtained from the service will be accurate or reliable
• Any errors in the service will be corrected

To the maximum extent permitted by law, RealIterate, LLC and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

You agree to indemnify, defend, and hold harmless RealIterate, LLC, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use of the service
• Your User Content
• Your violation of these Terms
• Your violation of any rights of another party

13. Third-Party Services

RealIterate may contain links to third-party websites or services that are not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party services. You acknowledge and agree that we shall not be liable for any damage or loss caused by your use of any third-party services.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of RealIterate after changes become effective constitutes acceptance of the revised Terms.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of RealIterate shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.

16. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RealIterate, LLC regarding your use of the service and supersede any prior agreements.

19. Apple App Store Terms

This license agreement is concluded between you and RealIterate, LLC only, and not with Apple Inc. ("Apple"). RealIterate, LLC, not Apple, is solely responsible for the licensed application and its content.

License Scope: The license granted to you is limited to a non-transferable license to use the application on any Apple-branded devices that you own or control, subject to the Usage Rules set forth in the Apple Media Services Terms and Conditions.

Maintenance and Support: RealIterate, LLC is solely responsible for providing any maintenance and support services for this application. Apple has no obligation whatsoever to furnish any maintenance and support services.

Warranty: In the event of any failure of the application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation whatsoever.

Product Claims: RealIterate, LLC, not Apple, is responsible for addressing any claims relating to the application or your possession and/or use of it, including: (i) product liability claims; (ii) any claim that the application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.

Intellectual Property: RealIterate, LLC, not Apple, is responsible for the investigation, defense, settlement and discharge of any third-party claim that the application infringes that third party's intellectual property rights.

Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Third-Party Beneficiary: Apple and its subsidiaries are third-party beneficiaries of this agreement, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce this agreement against you as a third-party beneficiary.
